Contested Divorces can take significantly longer, ranging from 1-2 years or more, depending on the complexity of issues like Property Division, Child Custody, and Support Arrangements. Each case is unique, and the timeline can vary based on factors such as Court schedules, and the level of cooperation between parties, and the type and location of various assets.
In Quebec, Child Custody Decisions are taken based on the best interest of the Child. The Court considers various factors including the child’s emotional bonds with each parent, the stability of the family environment, the parents’ capacity to care and provide for the child, the child’s wishes (depending on the age and maturity of the child). Despite shared custody being more and more common, the Court will determine the arrangement that best serves the development and well-being of the child.
